What This Notice Means

The IRS denied your request to extend the time to file Form 5330, Return of Excise Taxes Related to Employee Benefit Plans. The reason: your Form 8868, Application for Extension of Time To File an Exempt Organization Return or Excise Taxes Related to Employee Benefit Plans, wasn't received on time.

An extension request for Form 5330 must be received on or before the due date of the return. Yours wasn't, so you have no extension.

What to Do

Complete, sign, and file Form 5330 and pay immediately.

If Form 5330 is filed after the due date of the return, it's considered late. Late filing and late payment penalties may apply. The sooner you file and pay, the smaller the damage.

Don't forget the signature. An unsigned return creates another delay you don't need.

Penalty Relief

File and pay first. Then, if you had a real reason for missing the deadline, you can ask the IRS to remove the penalties for reasonable cause. Write down what happened and when, and keep the records that back it up.

Check Your Filing Requirement

If you aren't sure what your organization must file, review the filing requirements in the IRS retirement plan resources. They also cover employee benefit plans in general.

Questions

The IRS has a phone line for employee plan questions, with personal assistance on weekdays. You can authorize a representative to handle this for you using Form 2848.

Next Year
