Form 668-J is the Notice of Federal Estate Tax Lien under IRC Section 6324A. It is a specialized lien used only when an estate elects to defer payment of federal estate tax on a closely held business interest under IRC Section 6166. The §6166 election allows the estate to pay the tax over a period of up to 14 years, which gives families time to maintain operating businesses without being forced to sell to pay estate tax. Form 668-J secures that deferred tax.
Why the Special Lien Exists
Section 6166 defers estate tax but does not forgive it. The IRS needs security for the deferred amount because the general ten-year lien under IRC Section 6324 may expire before the §6166 payment period ends. Section 6324A creates a replacement lien that lasts for the entire deferral period. The special lien attaches to specific property identified in a §6324A agreement rather than to the full gross estate.
What Form 668-J Encumbers
The property subject to the §6324A lien is specific property pledged in a written agreement between the estate (through its qualified representative) and the IRS. The agreement must identify the property, show that its value is sufficient to secure the deferred tax plus interest for the deferral period, and bind each person who has an interest in the property. Once the agreement is in place, Form 668-J is filed in the appropriate recording office.
Real property valued under the IRC Section 2032A special-use election is subject to a separate §6324B lien, filed on Form 668-H, which operates on similar principles but secures the recapture tax that applies if the special-use valuation is disqualified during the recapture period.
Managing the Lien During the Deferral Period
The §6324A lien stays in place for the full deferral period. During that time, the IRS maintains an interest in the pledged property, and the executor or successor owners should be aware that transfers, financings, or dispositions may require coordination with the IRS. The lien is released on Form 668-K when the deferred tax is fully paid or when a substitute arrangement acceptable to the IRS replaces the collateral.
When This Form Shows Up
Form 668-J is not a collection enforcement document. It appears as part of an election the estate made voluntarily to defer tax. If a Form 668-J appears in an estate you are administering, the §6166 election is already in place. The important work has already happened. The ongoing issues are maintenance of the agreement, timely payments, and planning for the eventual release.
